Prenuptial Agreements
A Prenuptial Agreement is a contract detailing how couples will resolve issues should the marriage end in divorce. They sometimes contain provisions for property distribution upon death, but those provisions are better placed in a Last Will and Testament. Prenuptial Agreements are especially important for those coming into a marriage with children or property and allow each spouse to plan for his or her future by protecting assets and possibly avoid expensive litigation later.
A Prenuptial Agreement may also be called an “ante-nuptial agreement” or “premarital agreement”. In addition, a Post-Nuptial Agreement can be entered into at anytime after marriage.
Prenuptial Agreements are not for everyone. Parties who have considerable assets prior to the marriage or those who want to minimize the cost and time if they go through divorce generally utilize Prenuptial Agreements. Prenuptial Agreements are often used to limit, establish or eliminate alimony in the event of a divorce. They cannot, however, be used to settle future issues of child support or custody.
